Partner Visas

If you are in a genuine relationship with an Australian citizen, a permanent resident or an eligible New Zealand citizen, you may be eligible to be sponsored by your partner. You and your partner can either be in a married or de-facto relationship.

Prospective Marriage (Temporary) visa (subclass 300)

This temporary offshore visa allows a fiancé to come to Australia to marry an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.

The Sponsor and Applicant must:
  • Be at least 18 years of age
  • Have physically met or personally known each other
  • Marry the fiancĂ© within 9 to 15 months of the visa being granted
  • Commit to being in a genuine and continuing relationship
  • Apply for a Partner visa (subclass 820 and 801) before the Prospective Marriage visa expires
The visa holder can:
  • Live, work and study in Australia for between 9 to 15 months
  • Travel to and from Australia

Partner visa (subclass 820 and 801)

The onshore Partner (Provisional) visa (subclass 820) allows the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia temporarily until the outcome of the Partner (Residence) visa (subclass 801) is made. Once the Partner (Residence) visa is granted, the applicant will permanently live in Australia.

The Sponsor and Applicant must:
  • Be the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen
  • Be in a genuine and continuing relationship
  • Be in Australia when you apply
The visa holder can:
  • Live, work and study in Australia until the permanent Partner (Residence) visa (subclass 801) is decided
  • Travel to and from Australia
  • Attend up to 510 hours of free English language classes

Partner visa (subclass 309 and 100)

The offshore Partner (Provisional) visa (subclass 309) allows the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia temporarily until the outcome of the Partner (Migrant) visa (subclass 100) is made. Once the Partner (Migrant) visa is granted, the applicant will permanently live in Australia.

The Sponsor and Applicant must:
  • Be the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen
  • Be in a genuine and continuing relationship
  • Be outside Australia when applying
The visa holder can:
  • Live, work and study in Australia until the permanent Partner (Migrant) visa (subclass 100) is decided
  • Travel to and from Australia
  • Attend up to 510 hours of free English language classes
